1. Introduction
These Terms and Conditions (the "Terms") form a legally binding agreement between you ("you", "your", the "User", or the "Parent") and Adaptels Pte. Ltd.(UEN and registered office in Singapore; "Adaptels", "we", "us", or "our"), the operator of the QuizKin platform, available at quizkin.com, together with our applications and related services (collectively, the "Service").
QuizKin is an AI-powered, adaptive learning platform designed for children in Kindergarten 1 through Kindergarten 2 (ages 4–6) in Singapore. Users of the Service are parents or legal guardians who register on behalf of their children.
By creating an account, subscribing to the Service, or otherwise accessing QuizKin, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
2. Account Registration
- Eligibility. You must be at least 18 years of age and either the parent or the legal guardian of the child or children whose accounts you create. By registering, you represent and warrant that you meet these requirements.
- Parental consent for children's accounts. Any child profile you create under your account is operated solely by you on behalf of the child. You provide parental consent for all data collection and processing associated with the child account, and you remain responsible for the child's use of the Service.
- Accuracy of information. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.
- Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us promptly at [email protected] of any suspected unauthorised use.
3. Service Description
QuizKin is an AI-assisted learning platform for children that provides adaptive quizzes, progress analytics, and parental reporting features. The Service is designed to supplement a child's formal education and is not intended as a replacement for school, tutoring, or professional educational or developmental assessment.
We reserve the right to modify, enhance, add, remove, or discontinue any feature of the Service at any time, with or without notice. Where changes materially and adversely affect a paid feature you rely upon, we will use reasonable efforts to notify affected subscribers by email.
4. Payment & Subscription Terms
4.1 Plans and Billing
- Paid subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout) via Stripe, our PCI DSS-compliant payment processor. We do not store your full card details on our servers.
- All prices are displayed in Singapore Dollars (SGD) unless otherwise indicated and are subject to applicable Goods and Services Tax (GST) and other taxes required by law.
- Your subscription will automatically renew at the end of each billing period at the then-current renewal price unless you cancel before the next billing date.
4.2 Price Changes
We may adjust subscription prices from time to time. Price changes for an existing subscription will be communicated to you by email at least 30 days before they take effect. Your continued use of the Service after a price change constitutes your acceptance of the new price.
4.3 Cancellation
You may cancel your subscription at any time from the Parent Dashboard or by contacting [email protected]. Cancellation takes effect at the end of your current billing period; you retain access to paid features until that date.
5. Refund Policy
- 7-day cooling-off for new subscriptions. If you subscribe to a paid QuizKin plan for the first time, you may request a full refund within seven (7) calendar days of your initial charge, provided your account has not been used in a manner that materially exhausts the value of the subscription (for example, completing the bulk of available content).
- Renewals. Automatic renewal charges are not eligible for the cooling-off refund. If you forget to cancel and are charged for a renewal, please contact us within seven (7) days of the renewal charge and we will review your case on a good-faith basis, though a refund is not guaranteed.
- No partial refunds. We do not refund partial months or unused portions of a billing period.
- How to request a refund. Email [email protected] with the email address associated with your account and the approximate date of charge. Approved refunds are issued to the original payment method within 10 business days.
6. Learning Outcomes & Indemnification
This section is important. Please read it carefully.
6.1 No Warranty or Guarantee of Outcomes
Adaptels Pte. Ltd. makes no warranty, representation, or guarantee of any kind — whether express, implied, statutory, or otherwise — regarding the learning outcomes, academic progress, developmental milestones, examination results, school readiness, cognitive gains, or any other educational or behavioural results that any child may or may not achieve from using the Service.
6.2 Outcomes Depend on Factors Outside Our Control
You acknowledge and agree that a child's educational progress depends on a wide range of factors that are outside Adaptels Pte. Ltd.'s reasonable control, including but not limited to:
- the child's individual engagement, attention span, and motivation;
- the child's learning pace, prior knowledge, and cognitive and developmental profile;
- how frequently, consistently, and correctly the Service is used;
- the quality of the learning environment, parental involvement, and concurrent formal education;
- physical, emotional, developmental, or medical factors affecting the child; and
- any other individual differences that distinguish one learner from another.
6.3 Acknowledgement of Expectation Gap
You explicitly acknowledgethat the outcomes you or your child experience from QuizKin may differ — potentially materially — from your expectations, from our marketing materials, from testimonials, or from results reported by other families. No outcome is promised.
6.4 Indemnification
To the fullest extent permitted by Singapore law, you agree to indemnify, defend, and hold harmless Adaptels Pte. Ltd., its directors, officers, employees, contractors, affiliates, licensors, and agents from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- any dissatisfaction with, or claim regarding, the learning outcomes, educational results, or developmental progress (or lack thereof) of any child using the Service;
- any assertion that the Service failed to meet expectations, to improve performance on any assessment, or to produce any specific benefit;
- your breach of these Terms or your misuse of the Service; and
- any content, instruction, or supervision you provide to a child in connection with the Service.
This indemnification obligation survives termination of these Terms and closure of your account.
6.5 Supplementary Tool Only
QuizKin is a supplementary educational tool. It is nota substitute for formal schooling, qualified tutoring, speech or occupational therapy, professional educational assessment, medical advice, or any form of professional care or intervention. You should continue to rely on qualified professionals for your child's education and development.
7. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- share your account credentials with others or permit other households to use your subscription;
- use automated tools, bots, scrapers, or scripts to access, interact with, or extract content from the Service;
- attempt to reverse-engineer, decompile, disassemble, tamper with, or probe the Service for vulnerabilities (other than through responsible disclosure);
- interfere with or disrupt the integrity, security, or performance of the Service or any networks connected to it;
- upload, submit, or transmit any content that is unlawful, infringing, defamatory, obscene, harassing, or otherwise objectionable;
- circumvent or attempt to circumvent any access restrictions, usage limits, or security features of the Service.
Violation of this section may result in immediate suspension or termination of your account, with or without refund.
8. Intellectual Property
- Our IP. The QuizKin platform, including its software code, AI models, question content, algorithms, designs, graphics, trademarks, logos, and all other materials, is the exclusive property of Adaptels Pte. Ltd. or its licensors and is protected by Singapore and international intellectual property laws.
- Licence to you. Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for personal, non-commercial, household educational purposes only.
- Your content. If you or your child submit any content to the Service (for example, custom lesson notes or feedback), you retain ownership of that content and you grant Adaptels a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and display that content solely for the purpose of operating and improving the Service.
- Restrictions. You may not reproduce, distribute, publicly display, create derivative works from, or commercially exploit any part of the Service without our prior written consent.
9. Limitation of Liability
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
- To the fullest extent permitted by Singapore law, Adaptels Pte. Ltd. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to lost profits, lost opportunities, lost data, or damages for emotional distress — arising out of or in connection with your use of, or inability to use, the Service.
- Liability cap. Our total aggregate liability to you for any and all claims arising from or related to the Service shall not exceed the total fees actually paid by you to Adaptels Pte. Ltd. in the twelve (12) months preceding the event giving rise to the claim.
- Exclusions. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Singapore law, including liability for death or personal injury caused by negligence, for fraud, or for any other liability that applicable law prohibits us from limiting.
10. Termination
- Termination by you. You may close your account at any time from the Parent Dashboard or by contacting [email protected]. Active subscriptions will not be refunded for the remaining billing period unless they qualify under our Refund Policy.
- Termination by us. We may suspend or terminate your account, with or without notice, if you breach these Terms, if we reasonably suspect fraudulent or unlawful activity, or if required by law.
- Effect of termination. Upon termination, your right to access the Service will cease. We will delete or anonymise personal data associated with your account and associated child accounts within 30 days, subject to legal retention requirements. Backup copies are purged within 90 days. 11. Changes to Terms
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will:
- update the version number and effective date at the top of this page;
- notify you by email, by in-app notice, or by prompting you to re-accept the updated Terms the next time you log in; and
- give you a reasonable opportunity to review the changes before they take effect for you.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service and close your account.
12. Governing Law & Disputes
These Terms and any dispute, claim, or matter arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by, and construed in accordance with, the laws of the Republic of Singapore, without regard to its conflict-of-laws principles.
Subject to the arbitration option below, you and Adaptels Pte. Ltd. irrevocably submit to the exclusive jurisdiction of the courts of Singapore to settle any such dispute or claim.
Optional arbitration.At either party's option, any dispute that cannot be resolved through good-faith negotiation may instead be referred to, and finally resolved by, arbitration administered by the Singapore International Arbitration Centre (SIAC) under its Rules in force at the time of the dispute. The seat of arbitration shall be Singapore, the tribunal shall consist of one arbitrator, and the language shall be English.
